Connie, This can happen in any case of common law divorce only if kids are born with this couple only. This is between them not you. Sorry i wish i could help once you two are ex's the only thing you can ever get from him is his S.S if you where married over 10 years. When he passings away but nothing from the women he marrys are is in common law marrage with. Now if they where married and had an account together yes but him and her would know this which would mess that up if he owns montly payments ordered threw the courts because they would avoid this account but. Him not paying you can cost them money by putting him in jail if he does not pay the court order and than if he owes you back pay they will hold him untill someone pays you then maybe he will keep up the payments from here on untill.
