If DNA test exonerates the dad, should a woman refund the duped dad in paternity fraud?

There are a lot of deceitful ppl in this world and such a woman is one of them. I bet if every child in the world from the ages of newborn to 18 yrs old had DNA tests performed, close to 40% will come back showing their fathers are not their biological fathers. Millions of men are duped by their wives, girlfriends, or women from casual relationships into thinking they are fathers. Many women fear for their reputation, while others choose whose going to be their father based on their income. To answer your question.....yes, women should be forced to pay back child support money to duped fathers.

Short answer, no. No man should be forced to pay for a child that is not his, unless he's legally adopted the child. Unfortunately, some states still recognize a woman's husband as the father even if biologically he is not. That should be changed. I'm sure things like this go on more than we know.

Most states have a statute of limitations on financial damages related to paternity fraud.



If you wait too long not only will you get screwed out of any compensation but likely be forced to continue paying for the full 18 years.



All the more reason to insist on DNA testing for every birth.

If she knew he wasn't the father but accepted the money anyway, then yes she should have to pay it back...but then if he had ANY question about the kid being his, he should've had the paternity test done long before he ended up paying all that much in child support...



Bottom line...no, a guy shouldn't get screwed in the situation...he should not have to pay child support for a child that isn't his...

I think that if it can be proved that she KNEW it wasn't his child all along she should have to pay him back and there should be some legal follow up as well.



Problem is, unless people do the test when the baby is born, how do you know she's telling the truth?



I feel bad for him and all men stuck in this situation.

I don't think a man should have to pay for a child just because he boinked the mother. The mother is a terrible person to put this on another man. Personally I think the woman should pay the man all the money that he paid her. I am with the men on this one.

Are you close the child? Does the child see you as a father figure? If so, then why wouldnt you want what is best for the child? If this is the case then you should stop worrying so much about money.... If you are just being taken to the cleaners by some lady who is saying that you are the father of her child but a paternity test is showing otherwise then heck yes you should be entitled to get your money back... especially if you never had any visitation privileges. That is robbery...

It depends. If the man has a relationship with the child, continuing to pay support would be the right thing to do. It takes more than shared DNA to be a dad.

I don't know. The money has already been spent on the well-being of a child. It's not as if she bought a car with the money. Kids are expensive. The real father should pay the "duped dad." Although, this is a misnomer, as he isn't a dad.

I agree...if the child is not his, he should not be responsible for paying child support, and the mother should be responsible for paying any money back that she received fraudulently.
