Am I legally allowed to get rid of his stuff now?

I moved out of my place on the first and told my ex to pick up his things. He picked up a couple of things and has left everything else there. When I ask him if I should just get rid of it he says no. Well he hasn't been yet and I'm frustrated as is my old landlord.

Am I legally able to get rid of his stuff now? I'm not old enough to rent a moving truck (need to be 25) and I'm not going to pay to store his stuff.

Note: We were not married, I just didn't know where else to put this, we have been apart for a year and he just left his stuff there

If he left his stuff there and you remained in the home for a year, then I would assume that these belongings are now yours. Who's name was the rental agreement under? If it is under your name and the landlord has to remove the debris/belongings to re-rent the place, then you will be charged for the disposal of the items. I would tell him that if he is not going to pick up the rest of his belongings within five business days, then you are going to instruct the landlord to dispose of them as he/she sees fit. Or you will place the items out in front of the rental unit and post a notice on craigslist for free items. I would say depending on how long ago he "abandoned" his belongings will decide who they now belong too.

This would all depend on who rented this place. Was your name on it? Or just his? It is not your responsibility to take care of his stuff unless you were the one renting the place. Normally the land lord will get rid of things or sale them if the person does not come and pick them up after a certain amount of time.

So if you did not have your name on this place then you are not responsible to do anything with his stuff. It is his problem. If you all put up a deposit on it then you would not get it back if he did not clean up his stuff. Legally speaking if he is your ex then you are not responsible for anything that is his. If it has been a whole year since you were together then it is a little late for him to even get his stuff.

If he moved out a year ago and hasn't picked up the rest of the belongings then you can put them out on the curb for the garbage truck to pick up.

Box it and put it outside after notifying him it will be there. If it is not picked up within 24 hrs, you will notify goodwill to come get it! In re-reading it, if the "stuff" is at your old residence, it is not your problem. Let the landlord remove all that is not picked up

If the lease was in your name, tell him it's going out for garbage collection in 5 days. If the lease was in his name, then tell the landlord it's between him and the ex boyfriend.
