i am going through a divorce and pregnant with my boyfriends baby, who goes on the birth certificate?

everyone is telling me somthing different .. if the divorce is not final before the baby is born can i still put my boyfriend (the father) on the birth certificate? I live in michigan, usa

Actually, I just went through just about the same situation. I was married and got pregnant from my boyfriend. Unfortunately, your husbands name has to go on the birth certificate unless your divorce is final at least 10 months before the baby is born (which I don't believe is the case). If you put your boyfriends name on it, the state will run your SSN and see that you're married and change the father. 9-10 months after your divorce is final, you can have a paterniity test to OMIT your husband as the father and another one to prove your boyfriend as the childs father. Your husband has to be omitted first so unfortunately, you can't just have a DNA test for your boyfriend. Also, if you're receiving state aid, they will go after your husband until the court has proven otherwise (9-10 months after the divorce is done). If you are on assistaance, your husband has to pay for the DNA test and then when it is determined not to be his, he will be refunded his money. Your b/f will then take a test and when it is determined to be his, he will be reimbursed a PORTION of his costs. I hope this helps, trust me it's a HUGE headache. Good Luck! In Ohio, you can't get divorced until after the birth. The husband is put on the birth certificate by default, then once a paternity test is done, you have to go through the steps to correct it. In a lot of states, when a baby is born during a legal marriage, the legal spouse is the default parent until proven otherwise.

Regardless of what a lot of people think, who should be on the birth certificate and who the law says should be on the birth certificate are 2 different things. In Mississippi, the husbands name is on the birth certificate by default. Furthermore, in Mississippi you can not get a divorce while the woman is pregnant.

If the divorce is not final legally they will force you to put your soon to be exhusbands name on the birth certificate. I know this because it happened to me. You can have it put in your divorce papers who is the father. Then your ex will have to sign off or pay child support even tho its not his. They figure since your still married its up to your ex if he wants to claim the child or not. I know this sounds stupid, but i live in Grand Rapids, Michigan and this is what they made me do. I know it seems like a lie because we know who the father is yet it seems like they want us to lie. My ex signed off. Then the next step is to either have your boyfriend adopt his own child (which again sounds stupid) or you have to wait until the child is a year old and then you can go down to probate court and get a legal name change, which is what i did. They will make a new birth certificate which will come from Lansing, MI and the orginial one will be sealed so that no one can get it. Hope this helps you out and best of luck to you.

My friend went through the same thing a couple of weeks ago. she is still considered married but has a baby with her boyfriend. They would not allow him(the boy friend) to sign the birth certificate. they put him as the "presumed father" her husband had to go sign a paper saying he was not the father. but that is here in Texas. that would be a question you might want to ask the hospital.

The correct legal answer is...NO, you cannot list boyfriend. In MI if you are married at the time of the birth OR CONCEPTION, then hubby is the legal father until a COURT determines otherwise. Once the court legally determines paternity, then boyfriend's name can be placed on the birth certificate. You can call the vital records office to verify that.

Most of the time people put the FATHER to the child on the birth certificate. If you do not put the father, life will be complicated when it comes to putting the biological father on the birth certificate....



My husband's ex gf put another man on the birth certificate and we've had to go to court to prove that my husband is that child's father by DNA test. And now that we have a court order that states my husband is that little girl's father, things are a bit easier.

You put the baby's FATHER on the birth certificate. Why would you put someone else name on the birth certificate and they are not the father? Are you certain that your boyfriend is the father? Could there have been an overlap around the time you became pregnant? If so, you may want to get a paternity test. Best Wishes

Put the rightful father on the birth certificate. If you put your soon to be ex, he will be the legal parent of the baby and you may find yourself in the middle of a big nasty mess as you try to sort that all out. The baby deserves to have it's rightful parents on it's birth certificate.



Also, the ex might be on the hook for child support, which means you'll both have to go to court and he'll eventually have to give up his 'rights' to the baby. At that point, I believe the real father would have to adopt his own baby. It's a big mess all around. Be honest and straightforward now, it will save you lots of money and time in the future, as it will keep you out of court.



If the ex believes the baby to be his, you'll have to put his name on the birth certificate and then he'll need a paternity test to prove he's not the father, then he gives up custody, then the real father adopts the baby. That seems a lot of work for a poor little baby, not even born yet.

above all and any answer you get or regardless of what other people may have told you...but the natural child birth father's name goes on the birth-certificate regardless of any action of a divorce or break-up or whatever...putting the wrong name will only cause confusion and frustration in the near future...because some things in life require only the natural father not the step-father you never know what you may need the other half of the cell for or as some women say...the sperm donor... just know who is the natural father which is most important for right now you can get your divorce but know who your baby daddy is...ok

You put the father of the baby on the birth certificate. It doesn't matter who you are married to, the father of the baby goes on the birth certificate. If you put a man's name on your baby's birth certificate, and he's not the father, he can argue in court that it's not his, and he won't pay child support. And then, if you knew he wasn't the father, but you knew who was, and didn't put his name on the birth certificate, later on, the birth father can get out of any legal responsibilities to the child cause you knew he was the father, but put another man's name on the birth certificate anyway.

You should put the father's name on the certificate. Whether the divorce is final or not your boyfriend is still the father. Unless you are trying to make you ex husband pay child support for a baby that's not his. I hope that's not the case.

The biological father goes on the certificate whether you're married or not at the time.

Unless the not real father wants to be the dad and adopt the baby, the biological father will always be his legal father.

Putting your husband's name of the certificate when he is not the father can cause issues futher down the line. Put the baby's real father on the birth certificate.

ofcourse the boyfriend! i mean he is the father and your husband will be gone so in future if your child(god bless him) comes to you and say that who the bloody hell is "husband's name" on my birth certificate then well you will get uncomfortable answering him...so if you are gonna tie the knot with your boyfriend then it should definitely be his name.
