My soon-to-be-ex is dragging his feet on our mutually agreed-upon divorce. Should I file alone?

He said he'd refinance over 2 months ago, in the presence of a lawyer, and we agreed to file uncontested together. We get along, but this has been dragging on for almost 2 years. In the meantime, he's living in our condo and I'm getting fed up! I hate to be mean, but it's ridiculous! I know it's more expensive, but I can't stand to hear more promises from him.....any suggestions? PS Don't bother commenting on reconciliation. He cheated on me with a girl who wasn't old enough to legally drink....I think I'm too nice already for allowing him to stay in the condo.

Yes, he will continue to drag his feet until you put something in writing. I would consult your attorney ASAP and have a separation agreement drafted.

Yes you are to nice. Also, yes file separately. He is probably dragging his feet because he knows you won't fight him. He's already gotten two years in the condo why should he speed things up? The thing is he's not legally bound yet to do what he said he would in front of lawyers, its the judge that counts. Even though filing separately is more expensive you can have your lawyer try to get him to pay for your part of the divorce. He reneged on his part so in exchange for two years in the condo he pays your legal expenses. Sounds fair to me.

If you want to and can afford it, hire a lawyer and get the process started. You gave him plenty of time to help you out but he is obviously not going to do anything about it.

You can also do it without a lawyer (but if there are chilren involved l would advise you to take a lawyer, at least when it comes to custody). I took care of my divorce by myself but my now ex-husband and l were agreeing on everything, we had already separated the goods we had together, so it was easy. Either way, get the process started and file by yourself.

Kick him to the curb! You need a life for yourself and deserve to be happy. file with him! kick him out! He sounds like a leech a moocher a freeloaded thats taking advantage of your kindness. Put your foot down now or he just keep doing the same thing and it will drag on another 2 years! Stop wasting anymore of your life on him when you could of already been with a nice man in a serious relationship or even just dating. but as long as he is there he is still in a sense in part control of your life.

She has you over quite a barrel. If you want him divorced, there isn't a lot that can be done. He has been cheating on his wife and you are a home wrecker. Quit whining. The real beauty of the situation is that he wants badly to be divorced. If he wants to make a big deal about the refund, she might make that more difficult. Your "fence" should have gotten a written agreement along with the "virbil" one. Once the divorce decree is signed, their financial dealings are over. He would have no recourse to recover any of this money. fs

Try to file without the lawyer.If not contested you both will be a winner.Don't go to a lawyer,he will only work on your emotions and have you both upping the anti.You should be able to get a divorce for under $5OO.00.A layner cane represent both of you in this case.

An attorney does not represent both parties in a divorce. He/she represents the one who files and pays. Get busy, and get your stuff and your life back.
